This website www.pixomaya.com , including any subdomains thereof, and any other websites through which its services are made available, our mobile, tablet and other smart device applications, and application program interfaces etc, , (hereinafter collectively referred to as "pixomaya") is owned, hosted and operated by TechPiata Services LLP a company incorporated in India under the Companies Act, 1956 and having its registered office at 18-111/11, Krishna Nagar Road, Revenue Ward 5, Madhurawada, Visakhapatnam, Visakhapatnam (Rural), Andhra Pradesh, India, 530048. These terms and conditions, privacy policy and community guidelines regulating use of these Services constitute a legally binding agreement between Ppixomaya and the User (the “Agreement”).

By accessing or using Pixomaya’s services, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions and any relevant laws and regulations. If you do not agree, please refrain from using our services.

Services Offered

Pixomaya provides a range of technology-enabled digital services, including but not limited to:

• 2. App Development
• 3. Digital Marketing Strategy & Execution
• 4. ERP & Cloud-based Solutions
• 5. B2B, B2C, and D2C Enablement

Specific service deliverables will be outlined in individual proposals or project agreements and may vary by client requirements.

Client Obligations

Clients engaging with Pixomaya agree to the following responsibilities:

• • Provide Accurate Information All data, materials, and content required for service execution must be accurate and up to date.
• • Grant Authorization Clients must have legal authority to grant access to third-party platforms (e.g., websites, ad accounts).
• • Ensure Compliance Clients must not submit any content that infringes third-party rights, violates laws, or misrepresents facts.

Client Obligations

• • Service Charges Fees for each service will be clearly stated in the proposal or invoice shared with the client.
• • Due Dates Payment is to be made in accordance with the timelines specified in the agreement.
• Late Payments Delays in payment may result in paused services or additional late fee charges.
• Refunds Payments made are non-refundable unless explicitly outlined in the service agreement or covered under our Refund Policy.

Ownership & Intellectual Property

Until full payment is received, all creative content, campaigns, and intellectual assets developed by Pixomaya remain its property. Upon successful payment

• The client gains full ownership of deliverables unless otherwise specified.

• Pixomaya reserves the right to retain copies for internal records and portfolio purposes.

Confidentiality

We respect and protect client confidentiality. All data, documents, or business-related materials shared with Pixomaya will remain private and will not be shared with third parties without written consent, except where legally required.

Limitation of Liability

Pixomaya shall not be held liable for:

• Indirect, incidental, or consequential damages resulting from use or inability to use our services.

• Performance outcomes such as ranking positions, lead conversions, or ROI, due to the variable nature of digital platforms.

Termination Clause

• Client-Initiated Termination Clients may terminate services at any time by providing formal written notice. All fees due until the date of termination will remain payable.

• Pixomaya-Initiated Termination We reserve the right to suspend or terminate services for breach of contract, non-cooperation, or non-payment.

Use of Client Data in Testimonials

By agreeing to these terms, clients authorize Pixomaya to use their name, logo, and success metrics in case studies, testimonials, or marketing collateral unless a written objection is submitted.

Revisions & Amendments

Pixomaya may revise these Terms & Conditions periodically. All modifications will be updated on our website and communicated as needed. Continued usage after revisions implies acceptance.

Dispute Resolution

In the event of a dispute:

• Both parties agree to first attempt resolution through mutual dialogue or mediation.

• If unresolved, arbitration or legal proceedings may be pursued in accordance with applicable Indian laws.

Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the Republic of India. Any legal matters will be subject to the exclusive jurisdiction of the courts in Visakhapatnam, Andhra Pradesh, where TechPiata Services LLP is headquartered.
